Asylum EAD
The F family sought asylum in the United States and submitted their asylum application prior to engaging us. As 150 days had elapsed since the filing of the I-589, they were all eligible to apply for the Employment Authorization Document (EAD). We filed the I-765 in May and by early July, all four had received their EADs and SSNs, allowing them to join the workforce.

Mr. D is on an H-1B as an Assistant Professor at a university. He was due for an extension and we meticulously prepared the petition in March 2024. The petition was approved in July, only 4 short months later. He can continue to work until 2027.

Filed by the June 30th deadline, the petition was approved in early August, after less than two months.

We applied in June 2024 and he was approved in August. He awaits October to begin work in his new status.

Mr. O and his family are in the United States on an R-1 visa. His initial R-1 was about to expire, so we approached him about filing an extension six months before the expiration. We meticulously prepared the petition in February 2024. It took about 5 months total, including a straightforward Request for Evidence for approvals for Mr. O and his three dependents to be issued.

Mr. M had a pending asylum claim. Since 150 days had passed since filing the asylum claim, we were able to file for an EAD to allow him to work. The petition was filed in April, and by June he had an EAD and an SSN in hand, ready to enter the workforce.

We filed an initial R-1 petition for Mr. Q in March 2024, with a voluminous packet of evidence about the petitioner, the beneficiary, and the derivative beneficiaries. USCIS approved this petition in less than four months, so Mr. Q could begin his work as an Associate Pastor.

Ms. C is on an R-1 visa and had fulfilled the two year requirement for filing an I-360, the precursor to filing for a greencard for a Special Religious Worker. We painstakingly prepared the detailed petition and submitted it to USCIS. Within two months, Ms. C was approved. Now she is waiting for her priority date to become current so she can file for permanent residence.

We hope to hear from USCIS very soon.

PERM
Our client, an e-commerce company, has maintained a long-term relationship with the A&A team to handle H1-B work visas and EB-2/3 immigrant greencards for foreign employees. Upon receiving the assignment, we initiated an EB-2 petition for one of the client's foreign employees, who held a market analyst position. Working closely with the client, our attorney team conducted meticulous legal research, drafted the petition documents, and filed a prevailing wage determination application with the U.S. Department of Labor, which was successfully approved. Our attorneys then guided the client through advertising the job, organizing the hiring documentation, and filing the Labor Certification/PERM application with the Department of Labor. After one year and one month of waiting, the DOL approved the PERM application without any issues. Our client can now file an I-140 petition within 180 days. The foreign employee's EB-2 greencard application has now completed the first of three critical steps.

Our client, a U.S. citizen currently residing and studying in New York City, had reached the age of 21. She wanted to apply for a U.S. Green Card for her father, a Canadian national currently residing in mainland China. The A&A team counseled the client, and gathered all the necessary information and documents to prepare adequate and detailed financial evidence. Upon submission of the application, the green card application was approved in one year and one month.

Mr. A has had an R-1 visa since 2020. In that time, his job has taken him to different locations around the country. This most recent amendment relocated him to Los Angeles to become the Los Angeles Mission Pastor, We prepared the petition and filed it with premium processing in February 2024. By March, he was approved and in his new position.

Mr. G was one of the lucky ones selected in the FY 2024 lottery. His petition went out in June 2023. He did receive an RFE, to which we responded with detail and precision. The final result was that he and his wife were approved in late January 2024. He was able to start his H-1B job right after receiving this approval.

We did T's E-3 visa in 2021, and then did a transfer in 2022. His wife was not a part of either of those petitions because she was still on her F-1 visa. They came to us to make her an E-3 dependent in 2023, in the time that he remained on his visa. We filed and waited approximately 6 months for her approval to come through.

Mr. Y had an approved H-1B from his former employer but prior to the H-1B start date, was laid off. Concerned about losing his H-1B status, Mr. Y sought a new job and was fortunately able to receive a new offer. His new employer, however, was a small start-up company that had no history of sponsoring H-1B workers. Mr. Y found our law firm, and after analyzing the situation, we submitted a change of employer petition with Mr. Y's new employer in September. The petition was approved soon after and Mr. Y was able to preserve his H-1B status. He has since started working for the new company.

Naturalization
E was a permanent resident for 5 years, and we helped her apply to naturalize and become a citizen. A day before her scheduled interview, USCIS called her to tell her not to appear, that there was an issue with her physical file not arriving at the Field Office. She confirmed this information on another phone call and did not go. Shortly thereafter, USCIS issued a Notice of Failure to Appear. We helped her respond to that Notice and called USCIS several times until she was back in the queue for an interview. E waited over a year but finally got an interview scheduled, which we attended with her. That very afternoon, we got notice that USCIS would schedule her oath ceremony.

M is a Vawa self petitioner who was abused by her decease husband and was making a living by collecting bottles and cans. Her deceased husband refused to apply for greencard for her. After her husband passed away, we helped her collect all the evidence and apply for greencard and EAD card. After almost 6 months, she finanly received the Prima Facie Determination Notice, which means the supporting evidence has meet each of the eligibility requirements for the VAWA self- petition and the notice may be used to assist VAWA self-petitioners in receiving public benefits.

L is a Software Developer who was filing their third H-1B petition. Under current American Competitiveness and Workforce Improvement Act (ACWIA) regulations, an employer is not required to pay the fee if they had previously obtained an extension for the same indivdiual. L's second H-1B petition was filed when they changed their employer. This extension requested both an amendment and an extension, and included an ACWIA fee. The third extension included an ACWIA fee, which USCIS initially retured, only to issue an RFE asking for that fee. Our firm responded to the RFE requesting clarification on the application of the regulation and L's H-1B extension was successfully approved.

Asylum Removal Defense
Ms. T became our client through our pro bono program. When we took on the case, she and her son were both on an expedited removal process. We represented them in the master calendar and individual calendar hearings. We gathered documents from multiple parties such as social workers, physicians, church members, and family and friends; prepared them for potential questions from the DHS; and prepared their witnesses for potential questions. After months of effort, we were able to get her asylum case approved, so now Ms. T will have a protected legal status in the U.S. and her son will be able to adjust his status as well. We also helped her obtain work authorization and social security numbers.

X was laid off from his H-1B employer and has 90 days to look for a new employer. X's son is his H-4 dependent who's attending school in the U.S., we assisted by filing a new H-4 petition based on X's spouse's H-1B, so the son will not have any gap in his status if X was not able to maintain his H-1B. The petition was approved swiftly and X's son can continue his education.

Mr. S was a long-time H-1B holder who worked as a Music Director in Missouri. He started the greencard process in 2021. The PWD was determined, and the PERM was certified without an audit. We were able to file the I-140 and the I-485 together because the priority date was current for his country of origin. They received their EAD first, which would have allowed them to travel. The greencards came right after, without an interview. Both he and his wife are now lawful permanent residents.

This case is complex becuase Y did not have a well-kept records from five years ago, many documents are hard to locate due to the passing of time. However, we communicated diligently with Y and asked him to locate useful information in lieu of extensive documents. We carfully studied the RFE letter and addressed each concern raised by the USCIS, with the limited information we were able to gather, we build a compelling and extensive response. The RFE was approved within 5 days.

R-1 and I-360 NOID | Pastor
Mr. L works as a Pastor for a religious organization with various locations. After filing an R-1 amendment for a change in work location, and an I-360 for special immigrant status, Mr. L received an RFE, and then a NOID, for both applications. USCIS cited to a telephonic compliance review that resulted in discrepancies. We found that USCIS had conducted a single site visit at one of the three locations of the organization, without providing notice or properly communicating their expectations to our firm or the petitioner, after the visit. Both Mr. L and his employer were not at the location for the visit because of this lack of notice. In response, we provided several documents evidencing the organization's activities in each location while also addressing the problems with the current site visit process. We submitted the I-360 NOID response first, and as we were preparing the R-1 NOID response - before we even submitted it, we received an approval notice for both petitions based off the single I-360 response.

R-1 RFE | Assistant of Director of Education
Z works as an Assistant of Director of Education for a religious organization. Z received a RFE to her R visa application, where the USCIS raised questions about compensation. R-1 RFE | Chinese Director of Spiritual Care
Mr. F is a student currently pursuing his Master of Divinity in the US. He has over 5 years of ministry experience and was ordained as a pastor in 2015. However, he still received an RFE from USCIS when he applied for an R visa for the position of “Chinese Director of Spiritual Care” in a church. USCIS requested the petitioner to provide more evidence regarding the nature of this position, whether it is a religious occupation or a minister position. Because it was really urgent for Mr. F, we communicated with the client diligently, researched a lot of cases in the database, prepared the evidence zealously, and eventually put together a coherent and compelling response letter for Mr. F in a short period of time. Client Y applied for a change of status from F1 to R2 in July 2022. Y was a student in a Christian University, and is now applying for the R-2 based on her partner's R-1 visa. She received a RFE for maintenance of her F1 status, USCIS asked to prove that Y was properly maintaining her student status. We prepared her response to the USCIS, and the R-2 was approved within 8 days.

H-1B RFE | Administrative Assistant
Ms. H was working as an Administrative Assistant with the Petitioner on a valid F-1 OPT status when she applied for H-1B visa. She received an RFE from USCIS requesting evidence pertaining to Ms. H’s maintenance of F-1 student status, showing how working as an Administrative Assistant is directly related to Ms. H’s major area of study, Ministry. We gathered the Volunteer Agreement and some other documents which specified the job duties related to her major. We also searched for the SEVP Policy Guidance and finally demonstrated that working as Administrative Assistant is directly related to Ms. Yin’s major area of study, Ministry. We received the approval notice from USCIS in one week.

F-1 Approval | Foreign Correspondant
G was a South Korean national working in the U.S. as a foreign correspondent. She wanted to switch to studying in the U.S. and needed help transferring to an F-1 visa. Her application was filed in January 2022. The student office changed her status to F-1 before the application was approved, and this new I-20 triggered a Request for Evidence. We worked with the applicant and the student office to issue a correct I-20 and submitted this along with other evidence to show that she had not prematurely changed her status. In February 2023, her application was approved.

H-1B EAD Card Replacement
G never received his EAD card. It was lost in transit between USCIS and USPS. While G already had an H-1B approval and did not need the EAD card anymore, the card was important to have for his future Green Card application. We submitted detailed documentation related to the missing card, along with our joint efforts to track it down. USCIS approved the replacement card in less than a month.
