In the interim, he entered the lottery and was fortunately selected for the H-1B which is more advantageous since it is for three years as opposed to one. We applied in June 2024 and he was approved in August. He awaits October to begin work in his new status.

Mr. A has had an R-1 visa since 2020. In that time, his job has taken him to different locations around the country. This most recent amendment relocated him to Los Angeles to become the Los Angeles Mission Pastor, We prepared the petition and filed it with premium processing in February 2024. By March, he was approved and in his new position.

Mr. G was one of the lucky ones selected in the FY 2024 lottery. His petition went out in June 2023. He did receive an RFE, to which we responded with detail and precision. The final result was that he and his wife were approved in late January 2024. He was able to start his H-1B job right after receiving this approval.

H-1B EOS-RFE | Software Developer
L is a Software Developer filing their third H-1B petition. According to current American Competitiveness and Workforce Improvement Act (ACWIA) regulations, an employer isn't required to pay the fee if they previously obtained an extension for the same individual. L's second H-1B petition was filed when they changed employers. This extension requested both an amendment and an extension, including an ACWIA fee. The third extension also included an ACWIA fee, which USCIS initially returned. However, they issued an RFE asking for that fee. Our firm responded to the RFE, requesting clarification on the application of the regulation, and L's H-1B extension was successfully approved.

Professor N works at a Biblical university in California. He has been on an H-1B since 2016. We successfully filed his first extension in 2019. In July 2022, we filed his second extension, since he had an approved I-140. It took a while for USCIS to process this case as he had a concurrent I-485 pending. However, this August, we got the good news that his extension had been approved, and that the approval notice was on its way.

G's spouse is an H-1B holder with an approved I-140, waiting for his priority date. As such, his wife G is eligible for an Employment Authorization Document (EAD). She got her initial EAD in 2021. H-1B Cap Exempt RFE | PE & Enrichment Teacher
Mr. A works as a PE and Enrichment teacher at a K-12 private school, and he submitted a cap-exempt H-1B petition. The USCIS issued a RFE concerning the school's cap-exempt eligibility. We gathered documents, reviewed the memorudom of agreement between the school and higher education institutions, and replied to the RFE thouroughly and timely. The USCIS approved the petition within 2 weeks after the submission of the response.

Mr. Y works for a electronic sales company as a System Analyst on his H-1B visa. He has been on H-1B status for over five years and is seeking an extension of his H-1B status before the six year max-out date. He received a RFE, where the USCIS asked him to provide proof of maintanence of his H-1B status. This case is complex becuase Y did not have a well-kept records from five years ago, many documents are hard to locate due to the passing of time. However, we communicated diligently with Y and asked him to locate useful information in lieu of extensive documents. We carfully studied the RFE letter and addressed each concern raised by the USCIS, with the limited information we were able to gather, we build a compelling and extensive response. The RFE was approved within 5 days.

Ms. H was working as an Administrative Assistant with the Petitioner on a valid F-1 OPT status when she applied for H-1B visa. She received an RFE from USCIS requesting evidence pertaining to Ms. H’s maintenance of F-1 student status, showing how working as an Administrative Assistant is directly related to Ms. H’s major area of study, Ministry. We gathered the Volunteer Agreement and some other documents which specified the job duties related to her major. We also searched for the SEVP Policy Guidance and finally demonstrated that working as Administrative Assistant is directly related to Ms. Yin’s major area of study, Ministry. We received the approval notice from USCIS in one week.

In the spring of 2022, his employer, our Client, changed his work location, which necessitated an amendment to the original filing.
